Domestic Assault

Assault is the intentional application of force to another person without their consent or the threat of force to another person without their consent. Assault charges have significant consequences including fines, incarceration and a criminal record that can have travel and career implications. Those consequences can become more serious if the assault is of a domestic nature, including assaults between spouses and other family members, children included. You can be immediately forced out of your home and ordered to have no contact with the complainant and other members of your family.

Depending on the severity of the assault, our lawyers can often have the charges withdrawn subject to our clients entering into the Alternative Measures Program or a Peace Bond. These forms of resolution require that certain conditions such as counselling or restitution be completed.

One of the most common defences to an assault charge is self-defence. A person is entitled to defend themselves from force or the threat of force but all too often end up being charged for doing so. This is a complex area of law requiring experienced lawyers to properly defend such charges.
